This proposed zoning amendment is in follow-up to a 2018 consultation on dog-related noise in the Watson River Subdivision. Yukon government is proposing to amend the Carcross Development Area Regulation to further define “excessive noise” in the Watson River Subdivision (WR-1) zone (area show in Location Sketch). S. 32.2.1(d) is further defined as including:


1.       Any dog-related noise associated with a dog kennel within the Watson River Subdivision, on any part of a property, that can be heard on another property, at any time, day or night, and is continuous, sporadic, or erratic for any period of time in excess of ten consecutive minutes.

      2.       For the purposes of this section, the term “dog kennel” means a structure which provides shelter for 3 or more dogs for personal use, or a commercial establishment providing dogs with shelter on a short or long term basis.

The purpose of the proposed zoning change is to better define and address excessive noise related to dogs in the Watson River Subdivision. If an excessive noise complaint is received, steps will be taken by the Development Officer to determine whether the noise is considered excessive and to carry out any potential actions required to bring a property into compliance.

This property is zoned for agricultural purposes. Ancillary uses permitted on this property include one single-family dwelling unit. The applicant is proposing to rezone the subject lot to allow for an expanded range of ancillary commercial uses.

The purpose of the requested rezoning is to allow for the development of an agricultural tourism business. The applicant is proposing to rezone the subject property to develop a lodge, restaurant and ten guest cabins as ancillary uses.

Existing uses on the subject property are agriculture (growing hay) and one single-family dwelling unit.
